In Colorado, the dog bite statute imposes strict liability on the dog owner for injuries caused by his or her dog, regardless of the dog's vicious propensity. In other words, the dog does not get "one free bite," such as is available in some other states. This strict liability is imposed against the dog owner in cases involving serious bodily injury unless the victim was unlawfully on private property at the time of the injury or did not purposely provoke the dog. If no serious bodily injury was involved, the victim may recover damages if he or she is able to show that the owner's negligence resulted in the bite. If an owner has knowledge of a dog's vicious propensity, the owner must keep the dog in an escape-proof enclosure on the owner's property. If taking the dog outside of its enclosure, the owner must properly control the dog with a leash. If the owner has previously been found of violating the dangerous dog law, the dog must also be muzzled when outside of the enclosure.
